About HIPAA
Every American is deeply affected by HIPAA.
HIPAA is the common name for the "Health Insurance Portability and Accountability Act of 1996". Called "the most comprehensive healthcare law since Medicare", HIPAA required over a decade to roll out all its provisions. HIPAA was dramatically expanded in 2010 with the HITECH Act, which increased HIPAA penalties and modified critical HIPAA regulations.
HIPAA is designed to accomplish several vitally important Objectives:
- Establish Consistent Federal Rights for Patients – HIPAA supersedes the patchwork of inconsistent state-by-state laws on Patient Privacy and Medical Records Access, with a uniform federal framework of Patient Rights to access and control their own medical records and data.
- Reduce Healthcare Fraud and Abuse – which have in recent years consumed nearly one-third of the healthcare economy.
- Establish Federal Healthcare Transaction Standards – to replace the aging and wasteful system currently in use.
- Allow Health Insurance Portability – to help workers keep their health insurance coverage (for themselves and their families) when they change jobs or lose their jobs.
- Promote the Use of Electronic Health Records (EHRs) – The changes to HIPAA in 2010 from the HITECH Act strongly support this goal.
Training for All Employees Is Mandated by Law
HIPAA's creators knew that all healthcare workers would have to be trained in HIPAA if the legislation was to accomplish its objectives. Therefore the law requires that all healthcare workers be trained in the essentials of HIPAA. The law mandates workforce training on the basics of HIPAA, and on each HIPAA Entity’s HIPAA-related Policies and Procedures.
Employee Behavior Is the Most Serious Organizational Risk
While many Covered Entities struggle with HIPAA compliance to avoid potential fines and sanctions, many fail to realize that employees are potentially the biggest HIPAA risk.
HIPAA regulations are clear. Simple non-compliance can bring fines and other HIPAA regulations are clear. Simple non-compliance can bring fines and other sanctions. But criminal HIPAA violations carry the most severe penalties: up to $1,500,000 and jail terms up to ten years!
Healthcare employees, contractors, and volunteers use and disclose patient data and records on a daily basis. Make sure your people are not putting your organization at risk unnecessarily. To protect yourself and your organization, train everyone on HIPAA, and train them effectively.
